About this policy

HypeUp Marketing is a division of Prestige United Ventures Pty Ltd (ABN 21 602 137 217). In this policy, “HypeUp”, “we”, “us” and “our” mean Prestige United Ventures Pty Ltd trading as HypeUp Marketing.

We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains what personal information we collect, how we use and protect it, and how you can access or correct it or make a complaint.

It applies to our website (hypeupmarketing.com.au), our enquiry forms and booking calendar, and the services we provide to clients.

What we collect

We only collect personal information that is reasonably necessary for our business. Depending on how you deal with us, this may include:

  • Contact details: your name, email address, phone number and business name.
  • Enquiry details: the services you are interested in and anything you tell us in a message or on a call.
  • Booking details: the date and time of calls you book with us.
  • Client account details: billing contacts, invoices and payment records. Card payments are processed by our payment provider; we do not store full card numbers.
  • Communications: emails, SMS, call notes and, where you have been told in advance, call recordings.
  • Website data: your IP address, browser and device type, and the pages you visit (see Cookies and analytics).

We do not ask for sensitive information, such as health or financial-hardship details, through our forms. Please do not include it in a message. You can deal with us anonymously or under a pseudonym when you are only asking a general question, but we need your contact details to quote or provide services.

How we collect it

We collect personal information directly from you when you fill in a form on our website, book a call, email, phone or message us, or become a client. Occasionally we receive it from someone else, such as a person who refers you to us or a client who gives us their customers’ details so we can provide our services (see Client data we handle).

Cookies and analytics

Our website uses cookies and similar technologies to keep forms working, remember your preferences and understand how visitors use the site. We may use analytics and advertising tools, such as Google Analytics and the Meta Pixel, which collect information about your visit and may use it to show you our ads on other websites.

You can block or delete cookies in your browser settings. Some parts of the site, such as the enquiry form, may not work properly if you do.

How we use it

We use your personal information to:

  • respond to your enquiry and contact you about it by phone, email or SMS
  • schedule and run calls you book, and send booking reminders
  • quote for, provide, manage and invoice our services
  • improve our website and services
  • meet our legal, tax and accounting obligations.

Marketing

We only send you marketing emails or SMS, such as tips and offers, if you have agreed to receive them, for example by ticking the marketing box on our enquiry form. Agreeing to be contacted about your enquiry is separate and does not sign you up to marketing.

Every marketing message identifies us and includes a way to unsubscribe, as required by the Spam Act 2003 (Cth). You can opt out at any time by using the unsubscribe link, replying STOP to an SMS, or emailing hello@hypeupmarketing.com.au. We action opt-outs within 5 business days.

Automated tools and AI

We use automated tools to reply to enquiries, send booking confirmations and reminders, and pass messages to the right person on our team. If an AI assistant answers a call or chat on our behalf, it will tell you that it is automated.

These tools help us respond faster. They do not make decisions that could significantly affect your rights or interests, such as decisions about credit, employment or access to essential services, and a person decides whether we can take on your work.

Who we share it with

We do not sell your personal information. We share it only where needed to run our business, including with:

  • our related entities within the Prestige United Ventures group
  • service providers who host or run our systems, such as our CRM, website hosting, email and SMS, phone, scheduling, payment and accounting providers
  • advertising platforms such as Google and Meta, when we run campaigns
  • professional advisers, such as our accountants and lawyers
  • government bodies or others where the law requires or allows it.

Overseas disclosure

Some of our team works from our office in the Philippines, operated by our related entity Prestige United Ventures Inc., and may access your information to deliver our services. Several of our software providers store data on servers outside Australia, including in the United States.

When we disclose information overseas, we take reasonable steps to make sure it is handled consistently with the APPs, including through confidentiality obligations and access controls.

Client data we handle

When we build or manage CRM systems, campaigns, websites or AI receptionists for a client, we may handle personal information about that client’s own customers and leads. We handle it only to provide services to that client and on their instructions.

Our client remains responsible for how that information is collected and used, including having its own privacy policy and the right consents. If you are a customer of one of our clients, please contact that business first about your information. We will help them respond where needed.

Security and retention

We protect personal information with access controls, secure cloud systems, staff confidentiality obligations and training. We keep it only as long as we need it for the purposes above or as the law requires (for example, financial records for at least 5 years), then delete or de-identify it.

If a data breach is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC) under the Notifiable Data Breaches scheme.

Access and correction

You can ask for a copy of the personal information we hold about you, or ask us to correct it, by emailing hello@hypeupmarketing.com.au. We will respond within 30 days. If we refuse a request, we will tell you why in writing.

Complaints

If you think we have mishandled your personal information, email hello@hypeupmarketing.com.au with the details. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days.

If you are not satisfied with our response, you can complain to the OAIC at oaic.gov.au or on 1300 363 992.
